The Palo Alto Office of the City Attorney invites third year law students, recent graduates, and current judicial clerks graduated in the past two years from accredited law schools. For the 2015-2017 term, the Legal Fellow will focus on the areas of Sustainability, Land Use and Transportation. The ideal candidate will have strong writing and speaking skills, a commitment to public service, and a willingness to engage in practical problem solving in a fast-paced environment.
 
Palo Alto, like many communities in the San Francisco Bay Area, faces complex issues related to population and job growth, increasing traffic, and stresses on the environment and quality of life. With the population of Santa Clara County expected to grow as much as 36 percent by 2040, Palo Alto is already committed to promoting transit-oriented development, affordable housing, and transportation demand management. Palo Alto is also a pioneer in the fields of sustainability and climate change. One of the few cities in California to own and operate all of its utilities, Palo Alto provides 100% carbon neutral electricity and is exploring additional initiatives including a waste-to-energy program, green gas, distributed generation, rooftop solar and recycled water. The City also aims to be the nation’s most bicycle-friendly city within the next decade.

The 2015-2017 Legal Fellow will provide advice to the City Council, City Manager, and City departments in their efforts to guide the City on a path to sustainable, equitable, and responsible development.  Current and future projects that may be assigned to the Legal Fellow include:
 
  • Formation of a Transportation Management Association to assist small and medium-sized businesses to promote alternative transportation modes for their workers
  • Preparation and implementation of the City’s Sustainability and Climate Action Plan
  • Preparation of an Environmental Impact Report for the City’s General Plan Update, a document that will serve as the constitution for land use in the City through 2030
  • Development and implementation of green gas, distributed generation, rooftop solar, waste-to-energy, and recycled water initiatives with the City’s utilities department
  • Updates to the City’s development impact fees
  • Negotiation and implementation of a major flood control and wetlands restoration project
  • Litigation defending the City’s affordable housing program and other municipal land use and environmental initiatives
As part of a small team of attorneys, the Legal Fellow will also be expected to analyze legal issues throughout the diverse fields of local government law, which may include constitutional law, utilities regulation, public contracting, labor and employment law, government tort liability, government ethics, misdemeanor criminal prosecution and airport law. The Legal Fellow assists City Attorney’s Office staff in the performance of duties and responsibilities as the legal counsel of the City.

 
DISTINGUISHING CHARACTERISTICS
This is two-year, limited-term position for recent law school graduates.  Applicants must be law students in their final year at an accredited law school or joint degree program, current judicial clerks recently graduated from an accredited law school, or attorneys in their first year of practice.  Legal Fellows are expected to conduct routine professional legal tasks both under the supervision of an attorney and independently, including drafting legal documents, assisting in the preparation and representation of the City in litigation, prosecuting City codes and regulations, conducting research and providing advice to City personnel.

  • Assist in the representation of the City and its officers and employees in all litigation including preparation of dockets, anticipating defense, presenting evidence, developing case theory, pleadings, briefs, motions and other documents, preparation and trial of legal matters and handling of appeals. Appears before all Federal and State courts and administrative agencies.
 Minimum Qualifications:
Sufficient education, training and/or work experience to demonstrate possession of the following knowledge and skills, which would typically be acquired through:

BACKGROUND

The Environmental Law Programme (ELP) provides the principal source of environmental law expertise to the IUCN Programme. The work of ELP is carried out by the IUCN Environmnetal Law Center (ELC) in collaboration with the IUCN Commission on Environmental Law (WCEL), and the IUCN Regional and Country Programmes.

The ELP supports the development and implementation of international and national environmental law, provides technical assistance and promotes capacity building in developing countries, while also maintaining the world's premier environmental law information and data base service.
SPECIFIC DUTIES AND RESPONSIBILITIES
The primary responsibilities of the Legal Officer are :

A. Specific focus on the development, implementation and delivery of the Environmental Law Programme (ELP) component of the IUCN Programme 2013-2016 :

- Play a major role in the implementation of the IUCN-Programme 2013-2016, especially with regard to legal issues concerning nature conservation and climate change, as well as development of major knowledge products;
- Manage projects in the ELP areas work, including budgets and reporting requirements, and provide technical legal assistance to those areas;
- Carry out selected ELC project-related administrative duties;
- Search and identify potential sources of funding, develop project concepts and proposals;
- Contribute to programming and reporting for the ELP and to general IUCN programming as required;
- Organize and lead project related workshops and meetings in the area of his/her work, as appropriate;
- Manage and supervise the work of consultants in the projects withtin his/her area of work.

B. Other general duties pertaining to the work of the Environmental Law Centre :

- Ensure that the ELP expertise on the legal and institutional aspects of biodiversity-related issues is available to policy makers;
- Collaborate with IUCN's technical programmes to identify and meet their requirements for legal input;
- Collaborate with ELC legal and documentations officers, with the staff of IUCN's Regions responsible for environmental law, and with members of WCEL in project-related development work;
- Support the activities of the IUCN World Commission on Environmental Law (WCEL), and its specialists groups, as appropriate;
- Develop and prepate IUCN environmental law-related newsletters, reports, and publications;
- Supervise the work of ELC interns and fellows assigned to his/her area of work;
- Represent the ELC in relevant meetings and conferences;
- Take up any appropriate duties withtin the areas of work assigned by the ELC management.
REQUIREMENTS

• Juris Doctor or equivalent with strong academic record and emphasis on environmental law, including significant experience on climate change related issues and land-use planning, as well as regarding international conventions related thereto.

• A minimum of 8 years of increasingly responsible work experience in those fields. Work experience in developing countries is desirable.

• Proven experience in developing, fundraising and managing projects.

• A broad legal background, including private sector and/or government practice, experience with commercial and industry issues and legislative development desirable. Policy development experience an advantage.

• Excellent research, writing and analysical skills needed as well as an ability to work both independently and in a small, multi-cultural team.

• Experience in facilitating and participating with volunteer networks.

• Exceptional interpersonal skills.

• Computer literacy in basic office applications and the internet.

• Demonstrated ability to communicate effectively, including to a non-legal audience.

• Speaking and writing skills in English required and fluency on other IUCN languages (French and Spanish) desirable. Working knowledge of German is an advantage.

• Willigness to undertake significant levels of work-related travel.

As an Attorney-Advisor with the Department of the Interior, Office of the Solicitor, Northeast Region, Boston Regional Office, located in Newton, MA your specific duties will include: 
To perform legal work on behalf of two major clients: the National Park Service and U.S. Fish and Wildlife Service, and a lesser degree of work for the US Geological Survey. The work comprises three elements: advice work, administrative litigation or determinations, and assistance with judicial litigation handled by the Department of Justice on behalf of the Department. The work covers a wide variety of legal fields. The primary areas of practice for the selectee are expected to include administrative personnel litigation before the U.S. Equal Employment Opportunity Commission (EEOC) and general legal advice on areas of law relevant to our client agencies, particularly including Endangered Species Act (ESA) and National Envorinmental Policy Act (NEPA). Responsibilities

ELI periodically hires recent college graduates to serve as Research Associates. Research Associates work directly with the 15–20 lawyers and scientists in the Research and Policy Division on projects addressing environmental and natural resource protection and pollution prevention. A typical workload combines research and administration.
The Research and Policy Division publishes research studies and conducts a variety of training courses and workshops.
