JOB SUMMARY:

The Chief Counsel is part of the Treasury’s Legal Division, and reports to the Assistant General Counsel (Enforcement and Intelligence).

The incumbent works closely with senior officials at the Treasury Department, other federal departments and agencies, members of Congress, foreign counterparts, and the public on international economic and financial matters, including assisting the Department of Justice in litigation matters involving the Treasury Department.
The incumbent works under the supervision of the Assistant General Counsel (International Affairs) and is under the general direction of the Principal Deputy General Counsel and the General Counsel.  The incumbent manages eight attorneys and one administrative staff member in a dynamic, collaborative, and supportive environment.

While assignments are flexible and may change from time to time, the major duties of the Deputy Assistant General Counsel presently include
  • Supervision and direction of legal activities in the following areas, among others: legal issues involving the international financial institutions, such as the International Monetary Fund and the World Bank, the G-20 process, international banking and securities regulation, international trade and investment, the Committee on Foreign Investment in the United States (CFIUS), sovereign debt restructuring, energy and environment including climate change matters, international debt and development, a wide range of regional matters such as those relating to China, Europe, and the Middle East, litigation-related matters involving the Treasury Department, and a range of administrative law issues.
  • Supervision of attorneys performing legal research and providing legal and practical conclusions in the form of oral advice, briefings, presentations, and legal decision memoranda on extremely complex and difficult factual, legal, and policy issues. 
  • Overseeing the preparation or review of legal briefs and other litigation-relation matters as well as proposed legislation, regulations, Executive Orders, and policy issuances to ensure they conform to the substantive laws that they are intended to implement or interpret. 
  • Representing the Office of General Counsel, the Department, and the Office of International Affairs in discussions, conferences, and meetings with U.S. and international policy and regulatory authorities, in particular with other federal  authorities including the Departments of State, Commerce, and Justice and the Office of the United States Trade Representative, the international financial institutions, non-government organizations and civil society, regulatory and supervisory organizations, financial industry representatives,  congressional staff, and representatives of professional associations.

The incumbent establishes and maintains frequent contact with the Under Secretary for International Affairs, Assistant Secretaries for International Markets and Development and for International Finance, and over 15 deputates and offices within the Office of International Affairs.  He or she also consults with the officials and attorneys in other departments, agencies, and institutions on matters relating to the responsibilities of the Office of the Assistant General Counsel (International Affairs).
The incumbent plans, directs, and executes professional and technical programs of exceptional difficulty, responsibility, and national significance. A considerable part of the duties involves complex problems for which there are few guides, and the incumbent must rely upon his or her judgment, initiative, and experience. Original thinking and initiative is required, not only in matters of law, but also in those fields where recommendations are made in connection with formulation of policy and in managerial and administrative responsibilities.  In addition, oral and written presentation skills and the ability to summarize complicated legal problems, identify available options, and present them to a non-legal audience are fundamental to the position.The incumbent performs the duties of this position with broad authority, which carries with it wide latitude for the exercise of judgment in the day-to-day planning, direction, and management of the professional legal work of the office.  He or she is selected by the General Counsel upon the basis of extended experience and demonstration of exceptional leadership and excellence in professional practice and activities.

The Chief Administrative Judge controls and directs the day-to-day operation of the Board and is responsible for its internal organization and processes, including supervision of its administrative judges, attorneys, and administrative and clerical staff.  The Chief Administrative Judge oversees the legal work of the Board, including the assignment of appeals to attorneys and administrative judges and, on an almost-daily basis, issuing procedural orders on motions filed in cases not yet assigned to judges. 
The Chief Administrative Judge must be capable of assessing the facts and legal issues involved in every pending appeal, reviewing all proposed decisions of the Board to assure that they are consistent with previous decisions, applicable statues, regulations, precedents, and Departmental policy.  Because of the importance of the Boards decisions and their wide distribution and publication, an extremely high standard must be maintained as to their quality, factual accuracy, legal reasoning and articulation.
In the event an appellant files suit as a result of Board decision, the Chief Administrative Judge may assist the Department of Justice in the preparation of an appropriate defense to the litigation.  In addition, the Chief Administrative Judge represents the Board and its interests within the Department and before other government entities and the public.  The Chief Administrative Judge provides periodic reports to the Director of OHA on case load and other issues, and makes recommendations regarding budget, personnel, travel, space and supplies.

Applicants must have a J.D. or LL.B. degree and be current members in good standing of a bar of a State, the Districe of Columbia, or a territory or commonwealth of the United States.  YOU MUST PROVIDE PROOF THAT YOU MEET THIS REQUIREMENT.
Additionally, applicants must have at least seven years of progressively responsible professional legal experience.  Qualifying experience must be of a type and level sufficient to demonstrates the applicant’s ability to render final decisions in appeals covering a wide range of complex, highly contested issues in an efficient and timely manner.
As a basic requirement, applicants must demonstrate progressively responsible leadership experience that is indicative of senior level managerial capability and directly related to the skills and abilities outlined under Mandatory Qualifications below.  Typically, experience of this nature will have been gained at or above the GS-14/15 grade level in the Federal service or its equivalent with state or local government, the private sector, or nongovernmental organizations.  Failure to meet basic qualification requirements and all mandatory qualifications listed automatically disqualifies an applicant.
